The attorneys for an assistant prosecutor, who has accused a common pleas court judge of sexual assault, now want the visiting judge disqualified.

There is an active criminal investigation into Schuck over the accusations. That is being handled by the Montgomery County sheriff’s office. In November, the woman asked for a civil protection order to keep Schuck away from her. Frye was called in to preside over the case and granted a preliminary protection order. On Tuesday, attorneys for the woman asked the Supreme Court, which oversees visiting judges, to disqualify Frye from hearing this case. In an affidavit of disqualification, they allege that Frey has become a close colleague of Schuck since he has been a visiting judge in Schuck’s courtroom in the past. They claim that in November’s hearing, “Judge Frey demonstrated partiality” toward Schuck and seemed more concerned about the effects of the order on Schuck’s career and reputation. They also question why Schuck allowed the hearing to be open to the public, saying “what should have been an ex parte confidential” matter has now “become a public spectacle.” Before going to the Supreme Court, the attorneys first sent a letter to Frye asking him to recuse himself. He responded, saying, “I do not believe my rulings were incorrect or my questioning was one-sided,” and that “I have no reason to disqualify myself.” For now, the entire proceeding is on hold until the Chief Justice decides whether to disqualify Frye.
