The use of deadly force by Harrisburg Bureau of Police was ruled "justified" in the shooting of Bryan K. Horton Jr. on June 22 according to the Dauphin County DA, who said that Horton admitted he was trying to get shot and killed by police so he wouldn't have to go back to jail.
The DA says officers fired at Horton, who was in his car, while attempting to make a felony arrest. DA Fran Chardo added Horton made aggressive movements, indicating he had a gun and was going to use it. Officers believed he had a gun, which is why they opened fire, according to the DA. Horton was shot in the neck, arms, buttocks, and leg. Chardo says officers immediately rendered aid, ultimately saving Horton's life. After treatment for his wounds, the hospital released Horton, who's now held on new felony charges and a federal detainer.
The day after the shooting, the DA says Horton stated in the presence of medical personnel that he intentionally pretended to have a gun so that police would shoot him. He allegedly said he did this to avoid going back to jail. Horton had previously served a lengthy federal sentence for cocaine distribution. The Federal Bureau of Prisons released him on August 26, 2022, and he remained under federal supervision.
