It’s illegal to hold your cell phone while driving in Alabama. It's been a law for over a year, but police gave residents a one-year grace period to learn about the statute and get used to the change.
It’s illegal to hold your cell phone while driving in Alabama. The law took effect in June of 2023, but police began their official crackdown in June of this year.“The stipulation was they give 12 months of a warning, like a grace period, to give people an opportunity to come into compliance, to make sure they’re aware of the law being in effect. Since June of 2024, we’ve been issuing citations,” said Lt. John Angle with the Mobile Police Department.
Distracted driving claims thousands of lives each year in the US, according to the National Highway Traffic Safety Administration. That’s why Lt. Angle says his officers are taking the new law seriously. “It is a primary offense- if an officer is riding alongside a vehicle or sees a vehicle passing them where the operator of that vehicle is using a device, holding that device, that is a primary offense, they can pull them over just for that violation alone,” said Lt. Angle.A second offense is $100 and two points on your record.However, Lt. Angle says it’s not the fine that officers are worried about.
“We’re not looking to generate revenue,” said Lt. Angle. “We’re trying to make the roads safer. We’re trying to get people to understand how dangerous it is to be distracted from their mission of operating a motor vehicle.”Mobile police strongly encourage you to continue to practice hands-free driving habits when you’re behind the wheel. It could save a life.
