Alaska Sues Native Village Over Gaming Jurisdiction

The State of Alaska has filed a lawsuit against the Native Village of Eklutna, the U.S. Department of the Interior, and the National Indian Gaming Commission, alleging they violated the Alaska Native Allotment Act by operating a gaming hall on land the state claims was unlawfully considered a Native Allotment. The lawsuit centers on the question of jurisdiction over the land and pre-existing legal clarifications.

This is about jurisdiction over lands'ANCHORAGE, Alaska - The State of Alaska filed a lawsuit Tuesday against the Native Village of Eklutna, the U.S. Department of the Interior, and the National Indian Gaming Commission for violating the Alaska Native Allotment Act by operating their gaming hall on land that the state claims was unlawfully considered a Native Allotment.

The Interior denied Eklutna’s request in 2016, asking for a determination that they held jurisdiction over the allotment making the land eligible for gaming. NIGC and the Bureau of Indian Affairs concluded — under the Solicitor’s Opinion that the allotment was now under Eklutna’s jurisdiction and was eligible for gaming.

The Native Village of Eklutna is saddened and disappointed by Governor Mike Dunleavy and Attorney General Treg Taylor choosing to haul our Tribe into federal court and ask for a court order that would cause enormous financial damage to the Tribe and the community.
