New Alabama law in 2026 will bring stricter regulations to consumable hemp products like gummies and drinks, placing them under the oversight of the Alabama Alcoholic Beverage Control Board. The law aims to address underregulation, set THC limits, and prevent products from being marketed to children.
) - The start of 2026 also means some new laws are taking effect. One of the most notable ones for Alabama is stricter regulations on consumable hemp products. State Representative Andy Whitt told WAFF 48 News that gone are the days where you can walk into a convenience store to buy certain hemp products like gummies and drinks.
Whitt said consumable hemp items with Delta 8 or CBD were far underregulated, and this new law now puts these products under the Alabama Alcoholic Beverage Control Board.“What was so dangerous is that these products did not have a cap, and you and I could make these products in our basement, market them, and there was no one individual who was looking over it,” Whitt said. “These products will be tested, these sellers will be vetted by ABC, and there will be 21 and over stores that you will be able to get these.” It also places strict THC limits, capping most products at 10 milligrams per serving and 40 milligrams per package. Representative Whitt said most of these products were disguised as everyday candy, making it dangerous for children. “When you reach past a sour patch kids or what have you to get this product, that is not good, and we don’t want these products in the state of Alabama,” Whitt said. “I’ve heard from so many superintendents, also my wife was in education, and I saw firsthand the effects that these products had on our students, and when people tell you that these were not being marketed to kids, that is an absolute lie.”It could result in a class C felony with jail time up to 10 years and fines up to $15,000.Five people killed in three deadly Baldwin County crashes, authorities saySearch continues for missing 5-year-old from Walker County
