The Alabama High School Athletic Association (AHSAA) is facing legal challenges regarding its ruling on student-athlete eligibility after transfers facilitated by the CHOOSE Act. A temporary restraining order has been issued, allowing students who transferred schools using the CHOOSE Act to continue participating in sports while the case is ongoing. The AHSAA's original ruling aimed to make students ineligible for athletic participation for a year if they received financial aid after transferring.
AHSAA serves as the governing body for high school sports, including public, private and parochial, in Alabama. The governor and speaker asked a court to overturn the AHSAA ’s recent ruling that would have required some student-athletes who transfer to member schools using the“Our mission is to simply let the kids play.
We have been open to working with the AHSAA all along to ensure they do not unfairly and unlawfully discriminate against our CHOOSE Act student-athletes. Now is no different. With today’s court decision, the temporary restraining order remains in place, allowing our CHOOSE Act student-athletes to continue competing. We look forward to finding a permanent solution.”. Specifically at issue are students who transfer from one school to another using the CHOOSE Act. That law went into effect this school year and allows eligible families to tap into state funding to help pay for private school, transfer to a public school, and even homeschooling expenses. The AHSAA previously said it has a longstanding rule that any student who transfers to a new school and receives financial aid “is ineligible for athletic participation for one year.”Following a hearing on Sept. 5, Montgomery County Circuit Judge J.R.
