Actor Oh Young-soo, who had received a suspended prison sentence at first instance on an indecent assault charge, was acquitted on appeal. Criminal Appeals Division 6 of the Suwon District Court on the 11th overturned the lower court verdict that had imposed eight months in prison suspended for two years, and rendered an acquittal at the appellate sentencing hearing in the indecent assault case involving Oh.
The panel stated, “Given that about six months after this incident the victim received counseling at a sexual violence counseling center, told several close colleagues about it, and that when the victim sent a message demanding an apology to the defendant, the defendant apologized, there is reason to suspect that the defendant may have committed indecent assault as charged,” while also noting, “However, with the passage of time there is a possibility that the memory of the victim was distorted, and when there is doubt about whether the defendant committed indecent assault as described in the indictment, the conclusion must favor the defendant.” Prosecutors indicted Oh without detention in November 2022 on charges that in the summer of 2017, while staying in a certain province for a stage performance, he hugged woman A on a walking trail and kissed her on the cheek in front of her residence, committing indecent assault on two occasions. Regarding this, the first-instance court stated, “The contents of the diary kept by the victim and the records of counseling the victim received from an agency after this incident correspond in large measure to the details of the case, and the victim assertions are consistent and appear to be statements that could not be made without experiencing the events,” and it sentenced Oh to eight months in prison, suspended for two years, and ordered completion of 40 hours of a sexual violence treatment program. Oh, who appeared in the Netflix drama , became the first Korean actor to win Best Supporting Actor in the television category at the Golden Globes in the United States in January 2022.
