A group of attorneys general from 21 states, led by West Virginia Attorney General JB McCuskey, filed a lawsuit against New York State over its Climate Change Superfund Act. The lawsuit, filed in Albany, New York, names Attorney General Letitia James and other state officials as defendants.
It argues that the law, which requires major fossil fuel companies to pay into a fund over the next 25 years based on their past gas emissions, is unconstitutional and will lead to an energy crisis in the United States. It also argues that New York is attempting to blame a small group of energy producers for global greenhouse gases that originated from various sources. The states joining the lawsuit besides West Virginia are Alabama, Arkansas, Georgia, Idaho, Iowa, Kansas, Kentucky, Louisiana, Mississippi, Missouri, Montana, Nebraska, North Dakota, Ohio, Oklahoma, South Carolina, South Dakota, Tennessee, Texas, Utah, and Wyoming. They seek to prevent the implementation of the Climate Change Superfund Act, arguing that it will have negative consequences for the nation's energy independence and economic stability
