A coalition of 23 attorneys general, led by West Virginia Attorney General JB McCuskey, has filed a lawsuit against the New York state Climate Change Superfund Act . The lawsuit, filed in Albany, New York , names Attorney General Letitia James and other state officials as defendants. The act requires major fossil fuel companies to pay into a fund over the next quarter-century, based on their past gas emissions, to compensate for damages allegedly done from 2000 to 2018.

The states argue that the law is unconstitutional and represents an overreach of state power, potentially leading to an energy crisis and jeopardizing America's energy independence. They contend that the law unfairly targets energy producers and consumers in other states, forcing them to subsidize New York-based infrastructure projects. Additionally, they argue that the law wrongly places the blame for global greenhouse gases solely on a small group of energy producers, ignoring the contributions of numerous other sources.The lawsuit further asserts that coal, oil, and natural gas have historically played a vital role in supporting New York's economy and infrastructure. Joining West Virginia in the lawsuit are Alabama, Arkansas, Georgia, Idaho, Iowa, Kansas, Kentucky, Louisiana, Mississippi, Missouri, Montana, Nebraska, North Dakota, Ohio, Oklahoma, South Carolina, South Dakota, Tennessee, Texas, Utah, and Wyoming.
