) - A judge on Thursday ruled that prosecutors have enough evidence to move forward with charges against a man accused of aJai’Quan Ramsey, 19, of Mobile, is charged with first-degree assault and shooting into an occupied vehicle.

A grand jury now will consider whether to indict him.Detective Emmanuel Dillon, a youth services officer with the Mobile Police Department, testified at a preliminary hearing that he did not find Carlos Mitchell – who suffered a life-threatening gunshot to the abdomen – to be credible. He testified that Mitchell told investigators he simply was in the wrong place at the wrong time. In fact, Dillon testified, other occupants of the car told investigators that Mitchell was heavily involved in the dispute. He said they told investigators that Ramsey pistol-whipped a teenage relative of Mitchell and that Mitchell pointed a gun at the attacker but that it jammed. The officer testified that another man in the car, Tyrese Moore, fired in two different directions – including in the direction that Ramsey was running. A short time later, Dillon said, Ramsey returned and fired into the Ford Mercury. At least three bullets struck the car, one of them wounding Mitchell. Mobile County Assistant Public Defender Alec Cartwright argued that the charges should be thrown out. He told Mobile County District Judge Johana Bucci that the evidence comes from a witness that Dillon deemed unreliable and two of his relatives, along with Moore – who faces a charge of discharging a firearm in city limits arising from the same incident. “What this appears to me is Carlos Mitchell and his family members are making up a story after the fact because they know they’re in the wrong. … Their stories don’t add up,” he said. Mobile County Assistant District Attorney Richard Taylor argued that statements from two eyewitnesses satisfied the relatively low bar of demonstrating probable cause. Dillon testified that Moore could not identify Ramsey but told investigators that the man who fired the gun was the same man who pistol-whipped the person in the car. That teenager and another person in the car both picked Ramsey out of a photo lineup, the detective said. On cross-examination, Dillon acknowledged that police have not found any of the guns.
