The city of Cleveland released a letter sent to former Cleveland Mayor Dennis Kucinich Wednesday, saying he cannot file his appeal, or any lawsuit on behalf of the tax payers in an attempt to keep the Browns in Cleveland.

CLEVELAND, Ohio - The city of Cleveland released a letter sent to former Cleveland Mayor Dennis Kucinich Wednesday, saying he cannot file his appeal, or any lawsuit on behalf of the tax payers in an attempt to keep the Browns in Cleveland.

The letter, written by the city’s attorney Michael Quinlan, says the lawsuit filed by Kucinich cannot stand as the state prohibits lawsuits filed by non-attorneys on behalf of taxpayers. They site an Ohio Supreme Court ruling from Otto v. Patterson: “A taxpayer who is not a licensed attorney may not initiate and prosecute a taxpayer’s suit on behalf of others without the services of a licensed attorney . . . and where a taxpayer attempts to prosecute a taxpayer’s suit on behalf of a city and all other taxpayers similarly situated, without the aid of an attorney, the taxpayer is attempting to practice law in violation of the law.” Kucinich had initially filed a lawsuit against the city of Cleveland and the Browns in 2025, saying they both failed to legally enforce the lease to keep the Browns in Cleveland.
