Weis Markets is slated to pay a wrongfully terminated employee over $75,000 in a settlement following a sexual harassment and disability discrimination lawsuit, according to the U.S Equal Employment Opportunity Commission .
The EEOC states that a female employee at a Mifflintown Weis Market was subjected to a "sexually hostile work environment" at the grocery store, including unwanted touching and sexual remarks. The suit claims that two male supervisors failed to stop this activity after the inappropriate behavior was witnessed and reported. The suit also cites the general manager for their failures to bring action after the behavior was reported by the employee. Further details of EEOC's suit state that Weis Markets required the female employee to enroll in an Employee Assistance Program without proper cause or valid reasoning. The EAP program aims to help employees through mental health counseling; however, the suit states the female employee did not exhibit any signs of workplace deficiencies or behavior that could threaten others that would have constituted her enrollment in the program. When she refused to participate in the EAP, the EEOC says that she was suspended and ultimately fired by Weis Markets. Weis Markets and the EEOC were able to settle the case after the litigation was resolved by federal courts on June 17. The former employee was issued a $75,000 settlement from Weis Markets. Per the results of the case, the EEOC states that Weis Markets is prohibited from creating a sexually hostile work environment and must establish Title VII training, as well as EAP training that would enact new policies as to how employees are referred to the program. "This settlement provides fair compensation to the aggrieved employee in question," EEOC Regional Attorney Debra Lawrence says. And going forward, it also promises to greatly benefit Weis Markets' workers, the company, and the public interest.
