Governor Kay Ivey has signed the 'Let the Kids Play!' Act into law, reinforcing existing state legislation and preventing discrimination against students participating in athletics who also benefit from the CHOOSE Act. The new law establishes a process for challenging violations of the CHOOSE Act's nondiscrimination provision related to athletic eligibility.
- Gov. Kay Ivey signed Senate Bill 342, the “Let the Kids Play!” Act, into law Tuesday. The legislation is designed to reinforce existing state law and prevent discrimination against students participating in athletics while benefiting from the Creating Hope and Opportunity for Our Students’ Education Act.
“The Let the Kids Play Act stands up for students and families who followed the law and played by the rules,” Ivey said. The “Let the Kids Play!” Act establishes a clear mechanism for students and schools to challenge violations of the CHOOSE Act’s nondiscrimination provision to ensure they are treated fairly and in accordance with the law.
During Ivey’s State of the State address, she addressed the issue head-on, highlighting recent actions by the Alabama High School Athletic Association that sidelined student-athletes solely because their families participate in the CHOOSE Act. “Unfortunately, we have seen circumstances where the Alabama High School Athletic Association tried sidelining our CHOOSE Act recipients. Speaker Ledbetter and I even took them to court,” Ivey said during her State of the State address.
The bill applies to cases in which a student’s CHOOSE Act status is the only basis for denying athletic eligibility. The law does not prevent interscholastic athletic associations from enforcing rules that apply regardless of whether a student is a CHOOSE Act participant. Sen. Clyde Chambliss noted the bill’s importance in protecting student-athletes, stating that no student should be denied an opportunity in athletics because of their educational choice. Rep. Danny Garrett emphasized the role athletics play in a student’s development, stating the bill ensures that CHOOSE Act students are treated equally both in the classroom and on the field.
