Burton was sentenced to death in 1992, though it was another man, Derrick DeBruce, who shot and killed Battle during the incident.

) - Gov. Kay Ivey announced Thursday that the date has been set for the execution of Charles Lee “Sonny” Burton, who was convicted for his role as an accomplice in a 1991 auto store robbery that led to the shooting death of customer Doug Battle.

Gov. Ivey said a 30-hour time frame is scheduled to begin at 12 a.m. on Thursday, March 12, and will expire at 6 a.m. on March 13., Derrick DeBruce, who shot and killed Battle during the incident. DeBruce was originally sentenced to death but later resentenced to life imprisonment, leaving Burton the only man among the six who were involved in the robbery facing execution. The Alabama Supreme Court in January authorized Gov. Ivey to set an execution date for Burton using nitrogen gas. “Although I have no current plans to grant clemency in this case, I retain my authority under the Constitution of the State of Alabama to grant a reprieve or commutation, if necessary, at any time before the execution is carried out,” Ivey said in an official statement Thursday. Not reading this story on the WSFA News App?
