The Labour government is considering a significant overhaul of youth justice by potentially raising the age of criminal responsibility in England and Wales from its current threshold of 10 years old.
This move could lead to a scenario where police might no longer be able to charge children of certain ages—possibly up to 12 years old—with criminal offenses. Labour's Justice Secretary, David Lammy, has indicated that the government is evaluating whether the existing legal framework accurately reflects contemporary views on childhood, vulnerability, and developmental maturity in today’s society.
Critics, however, have warned that such a change could be perceived as a step toward 'soft justice,' particularly in light of Labour's previous policies, which included the early release of over 60,000 offenders from prison. The Ministry of Justice (MoJ) released a youth justice White Paper today, though it did not immediately recommend a new minimum age for juvenile accountability.
Instead, the document highlighted international examples, such as Scotland’s increase of the age of responsibility from eight to 12 in 2021, as well as recommendations from the UN Committee on the Rights of the Child, which advocates for a minimum age of 14. While the UK has seen very few cases involving children under 12 over the past five years—none of which resulted in custodial sentences—the MoJ acknowledged the strong public interest in this issue.
The age of criminal responsibility in England and Wales has remained unchanged since 1963, while other comparable jurisdictions have adopted higher thresholds. The ministry noted that some countries with higher minimum ages allow for exceptions in serious cases, such as Ireland, where children as young as 10 or 11 can be prosecuted for offenses like murder, manslaughter, rape, or aggravated sexual assault.
In his opening remarks for the review, Mr. Lammy emphasized the need for a comprehensive assessment of whether the current laws align with modern understandings of child development. Meanwhile, the government has welcomed ongoing research by the Bar Council and pledged to review its findings as policymakers evaluate potential reforms in the coming months
