'Zoning in Jerome Township is broken': Local housing case goes to Ohio Supreme Court

Tara and Ed Kunzelman found their piece of paradise on Brock Road in Jerome Township a dozen years ago, more than 23 acres of peace that they'd like to keep.But many others also want to live in the Union County township, which includes the Dublin school district. Pulte Homes is building a 248-home subdivision next to the Kunzelmans' property, which didn't start happening until the Ohio Supreme Court and a federal judge cleared the way.

● In October 2021, the Ohio Supreme Court cleared the way for a zoning referendum on the November 2021 ballot after developers filed a suit to try to prevent it. Voters shot down the rezoning by a 3-1 margin, 1,842 votes to 661. Among the terms of the consent decree was for the plaintiffs to pay the township $2.25 million for a new fire station and other township needs over the next 10 years. It also required developers to provide buffering and landscaping at the Pulte development, called the Homestead at Scotts Farm, named after the Scott family that owned the land.

Tara Kunzelman wrote in an email that Pulte has"completely disregarded" all requests to respect and mitigate the damages. She and her husband have even begun social media campaigns on Twitter and Facebook. "The residents have a right of referendum in state law, but it buttresses against the landowner's fundamental right to private property. It's a fascinating debate," he said.
