Thu, November 9th 2023, 11:42 AM UTCRochester NY – On Wednesday, November 9, US Attorney Trini E. Ross announced the conviction of a woman who faced several charges in relation to multiple threats made on Facebook Live in the summer of 2021.
22-year-old Gabygayl Cruz of Rochester has been sentenced to 130 months in prison for transmitting a threat in interstate commerce and possessing and discharging a firearm in furtherance of a crime of violence. The first incident occurred on the evening of June 7, 2021. During a live stream, Cruz threatened to shoot a man, encouraging viewers to “tune in in five minutes” at the end of the video. Later that night, Cruz and another individual traveled to an area where the man was known to spend time. She began to record a second live stream at that location, only displaying a black screen. Several gunshots could be heard from the feed, followed by the sound of running and giggling.
The second incident happened less than one month later on July 1, 2021. Once again, Cruz issued threats on Facebook Live, this time threatening to shoot a woman while displaying a .45 caliber firearm. She went to a residence on Columbia Avenue to confront the woman, but she was not there. While leaving the area, Cruz struck a parked car and fired a shot in the air.
Gabygayl Cruz was arrested the following day after being stopped by Rochester Police. Upon searching her vehicle, officers found a loaded .45 caliber semiautomatic pistol – the same firearm she displayed in one of the videos.
