The White House on Tuesday directed former White House counsel Don McGahn to rebuff a congressional subpoena for documents related to the special counsel investigation, escalating a standoff between the administration and Capitol Hill over Congress’s oversight efforts.

In a letter to House Judiciary Committee Chairman Jerrold Nadler , a lawyer for McGahn said he had been directed by the White House not to turn over the documents the committee requested “because they implicate significant Executive Branch confidentiality interests and executive privilege.” That direction came from current White House counsel Pat Cipollone, who said the directive in turn came from Mick Mulvaney, the acting White House chief of staff.

The McGahn lawyer, William Burck, told Nadler: “As you will appreciate, Mr. McGahn…continues to owe certain duties and obligations to the president which he is not free to disregard.” He continued: “Where co-equal branches of government are making contradictory demands on Mr. McGahn concerning the same set of documents, the appropriate response for Mr. McGahn is to maintain the status quo unless and until the committee and the executive branch can reach an accommodation.
