Weber Co. DUI driver stopped by UTHighwayPatrol with level 7.5 times over the legal limit
Scott Smith, 37, was arrested and faces multiple charges, including driving under the influence, failing to obey traffic control devices and driving on a suspended or revoked license.
According to the Utah Highway Patrol, a trooper was working the DUI shift Sunday when they saw a vehicle failing to maintain its lane after turning onto 24th Street. Smith was allegedly unable to maintain a single lane and straddled two lanes while on the road. The probable cause affidavit says Smith failed to stop at a stop line, instead going past a crosswalk and into an intersection.
A field sobriety test registered Smith's blood alcohol level at .331, just under the .40 level that doctors say can kill the person drinking. An open bottle of vodka was found inside Smith's vehicle, which also had an ignition device installed. After running a record check, the trooper learned Smith was driving with a suspended license.
