“For our clients' purposes, we're thrilled with this decision,” said Nick Stack, a partner at Shumaker, Loop, & Kendrick. The order only protects the 10 plaintiffs in the lawsuit, along with the distributors, retailers, carriers, and consumers of their products. Two of the 10 manufacturers suing the state are local: Urban Artifact and Greystone Brewing.
“We certainly hope that it'll help the marketplace for everybody in some way, shape, or form,” Stack said. The owner of 50 West Brewing, Bobby Slattery, said he's happy for his peers, but the order is not a win for the industry as a whole.
“For companies like myself, Rhinegeist, and Great Lakes, we're kind of sitting here saying, 'We've essentially now created winners and losers in Ohio and not clarity,'" Slattery said. When the law took effect in March, local breweries and retailers had to pull hemp-derived beverages from their shelves, and people also lost jobs.
“We have 10 to 15 employees that are sitting here asking, 'Well, how come over there at that company, they can do it, but we can't have our jobs back where we are, even though we were abiding by the exact same laws? '” Slattery said. "They were written in SB 56. Our politicians did it.
