A proposed class-action lawsuit alleges that San Antonio-based Visionworks of America Inc. was negligent in safeguarding private data and delayed notifying the public about a cyberattack that exposed the information of nearly 40,000 customers. The lawsuit, filed December 23 in U.S. District Court in San Antonio on behalf of an Arizona customer, claims that Visionworks' negligence allowed cybercriminals to obtain sensitive personal and health information during the October 10 breach.

The lawsuit accuses Visionworks of waiting nearly two months to inform the public and failing to notify affected individuals. While the company reported the breach to the U.S. Department of Health and Human Services as required by law, the report indicated the incident involved a hacking/IT attack via email, suggesting an employee may have fallen victim to a phishing scheme. To become a customer or employee of Visionworks, individuals were required to provide personal details such as names, dates of birth, email addresses, Social Security numbers, financial account information, medical information, and other private data. The lawsuit aims to have those affected recognized as a class and receive compensation for damages. Visionworks declined to comment
