A day after a murder charge fell apart in court, his lawyer on Wednesday criticized the Prichard Police Department’s handling of the case.

We're also learning of allegations that the detective at the center of this case has been untruthful in other cases.Mobile County District Judge Spiro Cheriogotis on Tuesday dismissed the charge against Kendarius Deontae Welch after Detective Jason Hadaway failed to appear for a preliminary hearing. In addition, two lawyers told FOX10 News that Hadaway’s truthfulness in prior cases has been questioned.

Carter told FOX10 News that Tuesday was the third setting for the preliminary hearing since he has been on the case. It would have been the second time the hearing was reset at the prosecution’s request. Typically, judges give both sides one opportunity to reset a preliminary hearing. If the case does go to trial, however, Hadaway could be subject to cross-examination about past statements he has made. Criminal defense lawyer Christine Hernandez told FOX10 News that she has brought those issues about Hadaway to the attention of the DA’s Office, which now must disclose that in information provided to defense lawyers.
