At least eight councillors from the coalition bloc were suspected of voting for Makwarela rather than the DA's preferred candidate, Cilliers Brink. In the motion, she states that her legal rights have been violated, specifically her constitutional rights - including freedom of association, expression, and speech. The first respondent, ActionSA, is hereby ordered to suspend the execution of the decision of the interim Senate of ActionSA to terminate the applicant's membership, Nkele Molapo.

The court notice stated that Molapo had to institute her challenge against the party within 30 days, or the interim order would lapse.
