A recent executive order signed by President Donald Trump has sparked widespread controversy by defining 'child' or 'children' as individuals under 19 years old. The order mandates that the United States government will not fund, sponsor, promote, assist, or support what it terms the 'transition' of a child from one sex to another. This effectively restricts federal funding to any institution providing gender-affirming medical care for transgender youth .
White House Press Secretary Karoline Leavitt has claimed that President Trump is 'delivering on his commitment to protect our kids' with this executive order. Leavitt has cited several hospitals across the country that have reportedly taken steps to comply with the order, including canceling appointments for gender-affirming care and suspending services for minors. These hospitals, according to Leavitt, include Langone Health in New York, Denver Health in Colorado, UCHealth, VCU Health, Children’s Hospital of Richmond, UVA Health, Children’s National Hospital, Northwest Washington Hospital, and Lurie Children’s Hospital of Chicago. However, New York Attorney General Letitia James has countered that regardless of federal funding, hospitals are obligated to comply with state laws prohibiting discrimination against individuals based on their sex, gender identity, or other protected characteristics. James asserts that all providers must continue to offer healthcare services, including gender-affirming care, to transgender or gender nonconforming individuals. The Department of Justice, in a notice to federal agencies, contractors, and grantees, has affirmed that federal agencies cannot halt or terminate any awards or obligations based on the President's executive orders, including those targeting DEI programs and gender-affirming care.
