Former President Trump is attempting to delay or dismiss a civil lawsuit filed by two co-founders of his social media company, Trump Media & Technology Group, citing his presidential immunity.
Two co-founders of former President Donald Trump 's social media company, Trump Media & Technology Group ( TMTG ), are suing Trump and several other company executives. The lawsuit alleges that Trump and his associates orchestrated a scheme to prevent Andy Litinsky and Wes Moss, the original co-founders, from receiving their rightful compensation. In response, Trump is arguing that he should be immune from civil litigation filed in state court while he serves as president.
He and his co-defendants, including FBI director nominee Kash Patel and White House Deputy Chief of Staff Dan Scavino, have requested a Delaware judge to either delay the case for four years or dismiss it entirely. Trump's legal team claims that defending himself against these lawsuits would be a 'distraction' from his presidential duties and 'interfere substantially' with the function of the executive branch. They argue that state courts across the country are being asked to judge the sitting president, which 'dishonors the Presidency and debases the state courts that purport to control his actions.' Trump's lawyers also point to President Bill Clinton's experience defending himself against a civil lawsuit while in office, suggesting that such legal battles can significantly detract from a president's ability to fulfill their responsibilities. This isn't the first time Trump has faced legal challenges during his presidency. He has been sued at least 10 times during his first term and returned to office with at least 14 lawsuits pending, including multiple suits related to his social media company. Notably, Trump placed his 14,750,000 shares worth more than $3 billion into a trust controlled by his sons before entering office this month. If successful, Trump's claim of 'temporary presidential immunity' could provide him with an additional layer of legal protection, following the newly broadened presidential power and immunity from criminal liability after the 2020 election
