Despite his upcoming presidential inauguration, former President Donald Trump is facing sentencing in his hush money case just 10 days before taking office. The judge has denied Trump's motion to dismiss the case and indicated he would not face jail time.

A judge on Friday ordered an unexpected conflict he must face just 10 days before inauguration. Trump was found guilty in May by a Manhattan jury on 34 felony counts of falsifying business records in an attempt to conceal a hush money payment to porn star Stormy Daniels in the run-up to the 2016 election. The decision means Trump will likely become the first felon to serve as U.S. president, though the judge indicated he would not face any jail time.

Manhattan prosecutors are balking at Donald Trump efforts to delay post-trial decisions in his New York hush money criminal case as he seeks to have a federal court intervene and potentially overturn his felony conviction. They lodged their objections in a letter Tuesday to the trial judge but said they could be OK with postponing the ex-president’s Sept. 18 sentencing. Justice Juan Merchan said he denied Trump’s motion to dismiss the case following his November presidential election victory. The judge said the Republican president-elect may appear for sentencing either in-person or virtually. Merchan wrote that a sentence of “unconditional discharge,” which means no custody, monetary fine, or probation, would mark “the most viable solution.” After Trump’s conviction, he faced up to four years in prison, but experts largely believe incarceration would be unlikely due to his age and lack of prior convictions, in addition to his current duties to fulfill his oath of office. Trump was originally supposed to be sentenced in July, but the date was postponed several time
