Former President Donald Trump has requested the Supreme Court to intervene in his ongoing criminal trial in New York, citing presidential immunity.
The Supreme Court has asked New York prosecutors to respond to Trump's request for a stay in his criminal trial by Thursday morning. Trump's lawyers argue that he is protected by presidential immunity, citing the Supreme Court 's recent ruling in a separate case. They claim the case should be dismissed as a 'meritless hoax'. Trump was convicted in May of falsifying records related to hush money paid to adult film star Stormy Daniels during the 2016 presidential election.
Judge Juan Merchan initially postponed Trump's sentencing in July following the Supreme Court ruling but later concluded that Trump does not have immunity until he is sworn in as president. The Supreme Court's contentious presidential immunity ruling came in a separate case where Trump was charged with seeking to overturn the 2020 presidential election results. That case has now been dropped. Trump's Supreme Court request was filed by lawyer D. John Sauer, whom Trump intends to appoint as solicitor general, and Todd Blanche, Trump's pick to be deputy attorney general
