The U.S. Department of Education is rapidly downsizing as core civil rights and special education responsibilities are transferred to the Justice and Health and Human Services departments, fulfilling President Trump's pledge to reduce federal involvement in education.

The Trump administration has accelerated the dismantling of the U.S. Department of Education by transferring core responsibilities to other federal agencies . The Departments of Justice and Health and Human Services are now tasked with key functions, including civil rights enforcement and special education oversight.

Education Secretary Linda McMahon, a former WWE executive, has formalized agreements to shift operations despite Congress alone having the authority to close the department. This move aligns with President Trump's campaign promise to return education to the states, though critics warn it will harm vulnerable student populations. The Departments of Justice and Health and Human Services will absorb the bulk of the Education Department's work protecting at-risk students.

The Office for Civil Rights, which investigates discrimination complaints, and the Office of Special Education and Rehabilitative Services, which administers billions in grants under the Individuals with Disabilities Education Act, are now under the purview of these agencies. While the Education Department will retain some duties like final case determinations and audit responses, the transfer eliminates most of its operational capacity. McMahon defended the reorganization as a way to reduce federal overreach while maintaining essential oversight.

Advocacy groups and Democratic lawmakers have condemned the reorganization as reckless. They argue that dispersing programs to agencies lacking relevant expertise will create coordination failures, leaving millions of students-particularly those with disabilities, students of color, low-income and rural students-without adequate protections. Representative Bobby Scott and Senator Patty Murray assert the move is politically motivated and will exacerbate educational inequalities.

The changes follow previous internal transfers, but Tuesday's announcement targets the most critical offices, sparking widespread concern about the future of federal educational equity and accountability
