Tyrese Simmons, 24, was on trial for murder in connection with the fatal shooting of Brandoniya Bennett in her Old East Dallas apartment, but it ended in a mistrial.The murder trial of a man accused of shooting into the wrong Old East Dallas apartment and killing a 9-year-old girl has ended without a verdict.
Simmons surrendered to police the day after the shooting and was released on bond in December 2019. Before his trial in June 2023, he tampered with his electronic ankle monitor and left Texas, court records show. “I am doing this to bring awareness to my case in hopes that it opens eyes to injustice in the system and lack of investigation.”The prosecutor, Christine Harris, wrote in a pretrial filing that Simmons “presents himself” as a member of a street gang on social media and that he associates with gang members.

Jurors began deliberations shortly after noon Thursday in the federal trial of a Dallas anesthesiologist accused of poisoning IV bags. Dr. Raynaldo Ortiz is charged with 10 counts of tampering with a consumer product and the adulteration of drugs. The alleged crimes happened at Baylor Scott & White’s SurgiCare in North Dallas over five days in August 2022. Federal prosecutors accuse the anesthesiologist of injecting heart-stopping drugs into five IV bags and placing them in a warming bin for other medical staff to use on their patients. Four patients suffered cardiac emergencies during low-risk cosmetic procedures which required them to be rushed to the hospital. Ortiz is suspected in 13 other unexplained emergencies between May and August 2022 but is only charged with tampering causing serious bodily injury to four patients.
