Court records show that many significant pre-trial documents, including witness and exhibit lists, have been recently filed by both sides. Timpa family attorney Geoff Henley tells us his office is making travel plans for his witnesses, and Godbey has reportedly cleared his docket for seven to 10 days.

Henley said the long wait for trial has actually benefited the family’s case in some ways. It gained strength in December 2021 after the 5th reversed a ruling by Godbey that Dillard and fellow officers Raymond Dominguez, Kevin Mansell and Danny Vasquez were protected by the doctrine of qualified immunity.The case has also been helped by public awareness of the May 2020 killing of George Floyd, who died after a Minneapolis police officer pinned him facedown on the ground in a similar way for more than nine minutes.

Each of the four officers involved was convicted of crimes related to Floyd’s death. And just 10 months after he died, the city agreed to pay Floyd’s family $27 million to settle a wrongful death claim. The Dallas justice system has churned much differently. In March 2019 Dallas County District Attorney John Creuzot dismissed misdemeanor charges against three of the officers in Timpa’s death, saying they could not be proven beyond a reasonable doubt. And Henley said the city attorney’s office, which declined to comment to us, has shown no interest in settling the case.
