Eric Longoria has been detained in either the Dallas County jail or a state hospital without a trial, stuck in the system intended to help him.
Now, every evening Gonzales lights a candle and turns a figurine of an angel to face a photo of her 40-year-old son. He was arrested in July 2017 and has been in custody for five years without a trial. Throughout the pandemic, Gonzales has connected with her son through video calls and, when permitted, visits him twice a week. His mother says he only asks a few questions before numbly nodding or shaking his head during her visits.
Gonzales said her son was passionate about music, but ultimately wanted to go into real estate to flip houses. He talked about moving to his hometown of Corpus Christi or to San Antonio. Bullets from a rifle pierced the living room window of an apartment, where a 2-year-old and two 16-year-old boys were. Three other people were in the bedrooms, the affidavit stated. One witness reported seeing Longoria go back into his apartment after firing the rounds.
Hospital staff determined in December 2019 that Longoria was not “manifestly dangerous,” and he was transferred to a minimum-security state hospital in Terrell. Perez did not respond to repeated requests for comment. Gonzales said he told her he wants off the case.Gonzales remembered her son’s deterioration during that time. In one visit, she said she found her son’s hair was past his shoulders and his nails were “at least three inches long.” She said she visited once to find him eating paper.
“The perception of the family member is that nothing’s happening, when in fact, there’s an attempt to do something, but we’re not successful,” Creuzot said.In September 2021, the evaluator determined Longoria was again incompetent to stand trial. According to Longoria’s docket, his fourth competency evaluation and malingering test have yet to be completed 17 weeks after they were requested. On Aug. 19, the case was transferred to Judge Dominique Collins’ court.
