Soon after the 90th anniversary of the mass trespass of Kinder Scout, our right to enjoy the countryside is regressing, writes PhoebeRSmith

where wild camping was officially allowed. That all changed at midday on Friday, when a High Court Judge ruled that the long-celebrated and documented right never actually existed.

It allowed even those among us who have no outdoor space of our own to fall asleep under the stars surrounded by the beauty of the moors and valleys. Such access should have been treasured and extended at a time when three quarters of children spend less time outside than prison inmates, according to a study from 2016.

There wasn’t any paperwork to complete, no money had to exchange hands and there was no concern that you’d be asked to move on. It began with a case taken to the courts by wealthy landowner and hedge fund manager Alexander Darwall and his wife, Diana, who own the Blachford Estate in Dartmoor. The Darwalls offer deerstalking, pheasant shoots and holiday accommodation on their land. At the time of their purchase, in 2011, wild camping was permitted on a section of the site called Stall Moor. That section is 3,513 acres, which is almost twice the size of Gibraltar.
