The rules will lay out factors like whether witness testimony will be heard publicly and whether Paxton’s wife, state Sen. Angela Paxton, will be forced to recuse herself from the trial. Lt. Gov. Dan Patrick hasn't said whether the Senate will actually vote on the rules Tuesday. The chamber is expected to hear recommendations from a seven-member committee that has been meeting behind closed doors over the last few weeks to draft out suggested trial rules. The panel of five Republicans and two Democrats is chaired by state Sen. Brian Birdwell, R-Granbury.

Paxton was impeached by the House on a 121-23 vote last month on 20 articles that accuse him of accepting bribes and abusing the power of his office to help a friend and campaign donor. The move triggered Paxton’s immediate suspension until the trial’s conclusion under the Texas Constitution.Convicting Paxton and permanently removing him from office requires support from at least 21 senators — two-thirds of the 31-member chamber.

Gov. Greg Abbott has appointed former Secretary of State John Scott to helm of the agency in the interim.
