A Texas judge ruled to have the state charges for 140 migrants accused of cutting concertina wire earlier this month dropped.

Razor wire and chain-linked fences have been installed by the Texas National Guard in towns along the southern border like El Paso. In response, Vandenbosch attempted to defend her case, saying that the actions listed in the affidavit and crossing the border illegally, were enough proof to move forward with the charges.

Two of those migrants were not relieved from these charges because one is not in state custody and the other one is facing different charges.The migrants involved in the April 12 incident are expected to be transferred to federal custody.
