In Austin, lawmakers are considering a bill that would create a criminal offense for illegally crossing the border into Texas, allowing all peace officers in the state to arrest undocumented migrants and order them to leave the country.
The Supreme Court’s decision was based on the fact that Arizona’s law impeded federal law, since it’s up to the federal government to decide when a person is subject to removal from the country. The Supreme Court’s opinion on Arizona’s law says, “the Government of the United States has broad, undoubted power over the subject of immigration and the status of aliens.” That doesn’t mean state and local authorities have no place in the process, but that place must exist in compliance with federal law.HB 4 would allow an officer to order people to leave and would create a punishment if they didn’t. That comes far too close to federal deportation powers.
