The Texas Attorney General's office is requesting documents from Irving Independent School District and Dallas ISD following concerns about their handling of transgender athletes' participation in school sports. The requests stem from communications with district employees suggesting transgender athletes could compete based on changed birth certificates, potentially violating a state law prohibiting participation in sports designated for the opposite sex.

The Texas attorney general ’s office requested documents Tuesday from school districts which employed people who suggested ways transgender athletes could participate with students born a different sex.

Reny Lizardo, who was the executive director of Campus Operations and Attendance Initiatives at Irving ISD before resigning, told an activistas the parent of a transgender student the district would allow a transgender athlete to participate with girls if their birth certificate was changed to show a female gender.

“The advice given by Mr. Lizardo seeks to directly circumvent this law and abdicate the district’s duty to protect interscholastic athletic opportunities for girls,” Ogle wrote. “Further, Governor Abbott has consistently reiterated that Texas only recognizes two sexes and that all state policy should reflect this fact.”

The activist also asked whether it would be okay if a student had an “updated birth certificate,” to which Gaston replied, “they said birth certificate. They didn’t say ‘original’ or ‘updated.
