“If an athlete does not have an honest and true opinion about the product they’re endorsing, it’s a violation to actually say, ‘Oh, I love this product!’” explained Brison, citing Federal Trade Commission guidelines. That last part is especially the truth, based on A&M’s early results from NIL, which is college athletes now being allowed to earn money for personal appearances and endorsements as of last summer.

As Lawson added, the “collectives” — a collection of boosters outside of the school who band together to raise money — are “following the rules.” And nearly a year into NIL, no one has appeared to take advantage of the new rules better than A&M former students. “I see it all,” said Brad Barnes, A&M’s associate athletic director for compliance. “And it’s been fascinating to see how this stuff has worked out so far in this first year.”

“The reality is on our campuses across the country 12.7 percent of student-athletes are transacting with their NIL … you get out what you put in. And this is a business that you’re now allowed to build.”
