Pesuruhjaya Kehakiman Mahkamah Tinggi Amelati Parnell mengeluarkan perintah itu terhadap Mohd Sahril Saharuddin, 29.Amelati memutuskan bahawa pihak pendakwaan telah berjaya mewujudkan kes prima facie terhadap Shahril dan memerintahkan dia untuk membela diri terhadap pertuduhan itu. Mahkamah menetapkan 24 Oktober untuk pembelaan Sahril.
