Officials in some states are pursuing policies that might clash with the legal precedent that children without legal immigration status are allowed a free public education in America.“Those are tax dollars that are paid right here in the state of Tennessee, by and large, by legal residents and U.S. citizens,” Lamberth told WZTV this week. “And so that money should be utilized at the local level to educate children that are here legally.

But she said “the scarier thing” now is the conservative makeup of the current court, which might see the issue differently if more states pursue laws or policies to challenge the right for undocumented children to attend public schools free of charge. Rodriguez said that could potentially weaken student privacy protections, including immigration status that law enforcement or other outside parties might seek.

“Name another agency, another law enforcement agency, that has those type of requirements that they can’t walk into a school or a doctor’s office or a medical campus,” Homan said. “No other agency is held to those standards. These are well-trained officers with a lot of discretion.”“Imagine, being 9 years old and worrying about your mom being at your house when you get home from school,” she said.
