A panel of state judges has backed the city of San Jose’s decision to clear the way for a “brutalist” building on a choice downtown site to be bulldozed.

SAN JOSE — A panel of state judges has backed the city of San Jose’s decision to clear the way for a “brutalist” building on a prime site to be bulldozed as part of the creation of a huge downtown tech campus.

San Jose’s approval of the tech campus, which was proposed by San Francisco-based development firm Jay Paul Co., also would require the demolition of several buildings on the eight-acre site. The property is bounded by Park Avenue, Almaden Boulevard, West San Fernando Street and South Market Street. Even though the focal point of the preservationist group’s lawsuit had been reduced to rubble, the activists nevertheless filed an appeal.

City officials acknowledged that the tech campus project would demolish several City View Plaza buildings with some level of historic and architectural significance, the state appellate panel noted. The preservation group also demanded in its appeal that project developer Jay Paul Co. mitigate the loss of the buildings in City View Plaza by establishing a fund to pay for the preservation of buildings elsewhere in downtown San Jose or even the city generally.“PAC*SJ has offered no authority to support its argument that compensatory mitigation, broadly directed at historic preservation generally , would serve as feasible mitigation,” the state appellate judges wrote in the ruling.
