While the Supreme Court often takes center stage, state courts will play a crucial role in limiting President Trump's actions during his second term. Although they cannot directly order the president, their power to check state and local officials, many of whom Trump will rely on to implement his agenda, will be significant. State courts can, and should, decide whether complying with federal requests violates state constitutions or laws, which often offer stronger protections than federal law.
As President-elect Donald Trump readies his return to the White House, courts will be one of the few conceivable checks on his actions. The U.S. Supreme Court , with the power to declare presidential actions unlawful, will likely get much of the attention. But another type of court will also play an important role during the second Trump administration: state courts .
Practically, there are far more state and local law enforcement officers than federal officers, which means that Trump and his surrogates will want state help to implement their agenda. They already have indicated they wantpolicing dissent. And more is sure to come. As Trump conjures new enemies, he will need more help pursuing them.
