A Spanish Fork man serving a prison sentence for assisting a classmate's suicide is now taking steps to appeal his conviction. The Utah Court of Appeals is considering the case.
SALT LAKE CITY — A man who was sentenced to a term of five years to life in prison for helping his classmate at Spanish Fork High School kill herself is now trying to appeal that sentence.
Utah County prosecutor Chad Grunander said at the sentencing that Przybycien, at 18, "pounced on her suicidal ideations and exploited them." He was initially charged with murder, but Przybycien pleaded guilty to child abuse homicide as part of a plea deal. Przybycien claimed his attorney did not inform him of everything or discuss his right to appeal after the sentencing, but Palumbo said the judge was correct to reject the request.
Palumbo, however, said Przybycien's trial attorneys advised him of the law at least five times before and after it went into effect, which was before his sentencing. Thompson's memorandum said the district court declined to consider whether Przybycien's attorneys consulted with him about issues that could be raised in an appeal when making the decision.
