The new law requires the agency to recalculate benefits for over 3 million individuals, including processing retroactive payments and adjusting future benefits.
However, the law lacked additional funding and staff to handle the increased workload associated with its implementation. The SSA highlighted this challenge in a Friday update, stating, 'SSA's ability to implement the law in a timely manner and without negatively affecting day-to-day customer service relies on funding.' Although the SSA is assisting some beneficiaries currently, under its current budget, the agency anticipates it will take over a year to adjust benefits and pay all retroactive benefits. Existing staffing shortages, exacerbated by a hiring freeze since November 2024, will further complicate the process, according to the SSA. All Social Security recipients, including those unaffected by the new law, will likely experience delays and longer wait times as the SSA grapples with the increased volume of work. 'We thank the public for its patience,' the agency added. To mitigate long wait times for inquiries about the Social Security Fairness Act, callers to the SSA's toll-free number are met with a recorded message providing information about the law. Despite this, over 7,000 individuals daily still choose to wait for a live representative, creating a backlog that is projected to worsen in the coming weeks and months. Signed into law in December by former President Joe Biden, the Social Security Fairness Act expands benefits for millions by eliminating two federal policies that previously penalized employees with public pensions from receiving their full Social Security benefits. It also addresses the reductions in benefits faced by the surviving spouses and family members of these workers. The benefit increase under the new law is retroactive to December 2023, meaning eligible recipients who previously received partial benefits will receive a full payment back to a year ago.The SSA emphasizes that processing these changes is a complex undertaking, requiring much of the work to be done manually on a case-by-case basis. The agency notes that some individuals' benefits may increase marginally, while others could see an increase of over $1,000 per month. The Biden White House had estimated the average monthly increase resulting from the law to be $360 for over 2.5 million Social Security recipients. The SSA advises individuals with public pensions whose Social Security benefits were previously penalized to ensure their name and address are current in their online profile at ssa.gov. While the SSA will reach out if necessary, they emphasize that there is no need to reapply for Social Security benefits.
