Parents claim their 8-year-old son was sexually accosted by a boy in school while a gym teacher was getting equipment from a closet.

The parents allege by the district failing to act on their earlier sexual harassment complaint that their son experienced a more severe incident that caused them to remove him from Beck Elementary School. The incident left their son so anxious and distressed, according to his mother, that she arranged for counseling, and with the agreement of a Children and Youth caseworker enrolled him in another school in the fall.
While the evidence suggests the conduct was severe enough for the parents to pull their son from school and seek counseling, Brann wrote in his view there is a legitimate question whether the two incidents make the sexual harassment “pervasive.”
