While he does not deny hiring male escorts from a purportedly legal escort service during two of his relationships, his legal team contends that he is being unfairly prosecuted for a practice widely accepted in American culture today.They claim that it is not uncommon for couples to involve a third person, including a man, in their intimate relations, and that no one has ever been prosecuted under the White-Slave Traffic Act for hiring male escorts from another state. According to Combs' attorneys, the Mann Act, named after Illinois Congressman James Robert Mann, was born out of a period of moral purity movements and was rooted in the hysteria surrounding white slavers preying upon young women, particularly young white women migrating from rural areas to cities. They argue that the act, which prohibits transporting people for prostitution or any other immoral purpose, has often been applied in a racially discriminatory manner, citing the case of Jack Johnson, the first Black heavyweight boxing champion, who was convicted in 1913 for transporting two white women across state lines during his relationships with them.Combs' legal team further points to the 1959 conviction of rock and roll legend Chuck Berry under the Mann Act for taking a 14-year-old Native American girl across state lines. They maintain that the statute's target was black male sexuality and that its most notorious prosecutions have targeted famous black men accused of deviant sexual behavior. Combs' attorneys assert that his case continues this trend, claiming that the male escort service he used was not some secretive underground operation. They state that the company has a website, 10,000 social media followers, write-ups in reputable publications, and even had its CEO featured on a Showtime TV series for six seasons. They argue that no one has ever been prosecuted for using this service before, and that no federal prosecutor has targeted the company, its CEO, or its escorts, nor has any prosecutor previously targeted any customer who purchased escort services from it. Combs' attorney emphasizes that Combs, a successful Black musician and businessman, is the first and only defendant ever charged under the Mann Act for hiring male escorts, making this a clear case of selective prosecution
