In a case that could further erode the power of the Environmental Protection Agency, the U.S. Supreme Court has agreed to consider San Francisco's claim that EPA requirements under the Clean Water Act are vague and make any attempts by The City to comply “impossible.”

“This court has already demonstrated its hostility to environmental legislation … The City has given the Supreme Court a chance to make it easier for polluters to pollute, and harder for the EPA and local regulators to protect the health of people and the environment.” The EPA has denied in court filings that the language of the permit provisions in question is too vague when stating limits — and the 9th Circuit Court of Appeals agreed. The Appeals Court said in its decision not to review the case that “the two narrative provisions were consistent with the CWA and its implementing regulations.” Additionally, the court held that the permit helps ensure discharges are consistent with California’s other applicable water quality standards.
