This is not the first time Garcia has been accused of such acts. The incident at Scottsdale Village Square began on January 28th when police received a report of a sexual crime.

The facility's director informed police that she received a call from the alleged victim's adult son who witnessed his mother engaged in a sexual act with an employee through a live camera in her room. Court documents contain graphic descriptions of the alleged act. Garcia was originally scheduled to return to work on January 29th but was suspended pending an investigation. The victim, diagnosed with dementia and Alzheimer's, told police she was unaware of the incident. Garcia was arrested on January 31st and admitted to his actions after seeing the photos. He reportedly told police that raising his autistic son at home was difficult and impacting his marriage.Court documents also reveal that Garcia is the suspect in another sexual assault case being investigated by the Maricopa County Sheriff's Office at a facility called Fountain Hills Post Acute. The incident reportedly occurred in March 2024. Findings from the Department of Health show that one patient accused Garcia of massaging her neck and shoulders after removing her top and making her uncomfortable while cleaning her chest. Another resident claimed Garcia frequently lingered around their room and attempted to massage their arms. Garcia declined to interview with state officials, citing privacy concerns. On March 6, 2024, the Director of Nursing at Fountain Hills Post Acute informed officials that Garcia had been fired for refusing to cooperate with the investigation and for not following facility protocol. The facility received two citations from the state for violating residents' rights and failing to protect them from abuse and neglect.In the case involving Scottsdale Village Square, Garcia faces charges of sexual assault and emotional abuse of a vulnerable adult, both felonies. A judge set a $100,000 bond for Garcia, with conditions prohibiting contact with the alleged victim, possession of drugs without a prescription, and unaccompanied contact with vulnerable adults. Questions remain about whether Scottsdale Village Square staff were aware of the allegations against Garcia from Fountain Hills Post Acute before hiring him. The facility has yet to respond to requests for comment.
