Prior to driving off the cliff edge onto a rock outcropping and then into the water, Chavez and the boys spent time sitting on the bench at the end of Sunny Cove Drive and down on the nearby beach, according to testimony.

One of the boys allegedly told Santa Cruz County Sheriff’s Office investigators that the family went back to the car when the other brother began to cry about wanting to get to school, detectives said. First, however, Chavez allegedly filled a cup she had brought from home with ocean water. She later allegedly dropped an angel figurine into the water, took a sip and told the boys she was praying for a miracle, affording to testimony.

According to investigators’ interpretation of witness interviews and video evidence, Chavez then appeared to back up down Sunny Cove Drive before traveling forward at a high rate of speed for about the distance of a football field and off the cliff. The boys allegedly told detectives that they could not escape the rapidly sinking car until they told Chavez to escape via her open window. One reportedly yelled to a nearby surfer for help before the two followed their mother out of the car.
