Officials in Santa Clara County announced on Thursday that they have filed a federal lawsuit challenging President Trump's executive order aimed at ending birthright citizenship . The lawsuit, which names President Trump and other high-ranking federal officials as defendants, asserts that the order violates the 14th Amendment of the U.S. Constitution.

Santa Clara County Board of Supervisors President Otto Lee stated in a press release, 'Executive orders that clash with the Constitution lack legal validity and only generate unnecessary confusion and hardship for immigrant families and all Americans.' President Trump's order, issued shortly after his inauguration on January 20th, seeks to deny birthright citizenship to children born to immigrants who are in the U.S. illegally or on temporary visas. The U.S. government has traditionally interpreted the Constitution to grant citizenship at birth to individuals born on American soil, regardless of their parents' immigration status.The 14th Amendment, ratified in 1868, explicitly states: 'All persons born or naturalized in the United States, and subject to the jurisdiction thereof, are citizens of the United States and of the State wherein they reside.' California played a significant role in establishing this precedent in the late 19th century. Wong Kim Ark, a Chinese-American born in San Francisco, was denied re-entry to the U.S. under the Chinese Exclusion Act. A landmark decision by the U.S. Supreme Court in 1898 affirmed his right to citizenship under the Citizenship Clause of the 14th Amendment. County Counsel Tony LoPresti emphasized, 'No president possesses the authority to enact, amend, or repeal statutes, let alone the Constitution itself.' He added, 'This order illegally directs federal agencies and officials to disregard and fail to execute a wide range of laws that rest on the fundamental constitutional foundation of birthright citizenship.' Santa Clara County officials stressed that if the order were implemented, thousands of residents would be affected, including refugees and asylees awaiting green cards, professionals working under H-1B visas, students residing on visas, and individuals in the U.S. illegally. According to U.S. Census data, over 40% of county residents were born outside the United States, an estimated 773,000 people. Moreover, over 60% of children in the county have at least one foreign-born parent, representing the highest percentage in California and among the highest in the nation. The executive order has already faced legal challenges. A federal judge in Seattle issued a 14-day restraining order on January 23rd.
