SAN JOSE — In one of his final policy moves in office, outgoing Mayor Sam Liccardo is pushing to make good onto move San Jose Police Department misconduct investigations away from cops and into the hands of a civilian watchdog.

The council’s vote means that the city now will explore and report to a San Jose public-safety committee how it could implement the model in which misconduct investigations would be shared between Nurre’s office and the internal affairs unit at the San Jose Police Department. “It doesn’t matter how good our police department is, we’re past the point where Americans will simply believe that the police should police themselves,” Liccardo said. “Police misconduct simply is not a matter of ‘internal affairs.’ … A single act can have very profound impacts on our public, and to build our community’s trust, we must take these initial steps toward more independent investigation of police misconduct.

“Nothing in the City Charter permits the IPA to flout these limits and conduct her own independent investigations. And nothing gives the Council the authority to expand the IPA’s powers,” union attorney Gregg Adam wrote. Liccardo refuted that characterization at Tuesday’s council meeting, saying that city leaders’ desire to reform the investigation framework for police misconduct has long been clear, galvanized by the 2020 civil unrest spurred by the police murder of George Floyd in Minneapolis.
